Terms of Service
Effective: October 7, 2026
These terms are an agreement between you and InMemoryVideo. They apply when you visit inmemoryvideo.com, create a project, add photos through a family link, buy a video, or watch a memorial page. Please read them. If you don't agree with them, please don't use the service.
The short version
- You upload photos, we assemble a memorial video automatically, and you watch a free preview before paying anything.
- Downloading the finished video costs $59, paid once. There is no subscription.
- If you're not happy, you can get a full refund within 30 days of payment.
- Your photos stay yours. We use them only to make your video and memorial page, and we don't train AI on them.
- Please upload only photos you have the right to use, and download your video once it's ready.
This summary is here to help. The full terms below are what applies.
1. About these terms
1.1 Who we are
InMemoryVideo is operated by Dmitrii Korpachev, an individual based in Ubud, Bali, Indonesia, trading as InMemoryVideo ("InMemoryVideo", "we", "us", "our"). You can reach us at support@inmemoryvideo.com.
1.2 Words we use
- "Service" means the website at inmemoryvideo.com and everything you can do through it: creating projects, previews, videos and memorial pages.
- "Project" means the workspace where photos, text and settings for one video are kept.
- "Your content" means everything that you or the people you invite add to a project: photos, names, dates, captions and other text.
- "Video" means the memorial video the service makes from a project. "Preview" means the free version with a watermark.
- "Memorial page" means the web page where a paid video can be watched through a link.
- "Family link" means the link you can share so that relatives and friends can add photos to your project.
1.3 Other documents that form part of these terms
Our Privacy Policy, Refund Policy and Cookie Policy are part of these terms. If something in the Refund Policy is more generous to you than these terms, the Refund Policy applies.
2. Who can use the service
You must be at least 18 years old to create a project or buy a video. If you use the service on behalf of a family, a funeral home, a church or another organization, you confirm that you are allowed to accept these terms on their behalf.
Relatives and friends who add photos through a family link may be younger, as long as a parent or guardian agrees. Contributors agree to the parts of these terms that apply to what they upload (sections 7, 8, 10 and 11).
3. How the service works
3.1 Projects and private links
You don't need an account. Each project is saved at a private link. Anyone who has the link can open and change the project, so treat it like a key: share it only with people you trust. We can't tell who opened a link, and we aren't responsible for changes made by people you gave the link to.
If you give us your email address, we'll send you the link so you don't lose it. If you lose the link after buying a video, write to us from the email you used at checkout and we'll help you get back in.
3.2 Family links and contributors
You can share a family link so others can add photos to your project without making an account. Photos added this way appear in your project, and you decide which of them go into the video. You can turn the family link off at any time. If you are a contributor, please add only photos you have the right to share and that suit a memorial.
3.3 Automatic assembly
The service assembles the video automatically. It suggests an order for your photos from childhood onward by estimating roughly how old people look in each photo, crops photos so that people stay in the frame, and times transitions to the music you choose. These are suggestions made by software, and they can be wrong: an old photo of a young person can look newer than it is, and a group photo can be hard to place. Please check the order and the framing before you pay. You can move any photo, and you can arrange the photos yourself if you prefer.
The service doesn't identify who anyone is. More about how this works, and what data it uses, is in our Privacy Policy.
3.4 Preview and changes
Before you pay, you can watch the whole video as a preview with a watermark and at lower resolution, and change it as often as you like. After you pay, you can still correct the project and download the updated video during the first 30 days. After that, corrections may not be possible because the project files are kept only as long as described in section 5.4.
3.5 Early access
We may open the service to families gradually. If you join our early access list, we'll email you when you can start. Joining the list doesn't oblige you to buy anything.
3.6 Help from us
You can write to us for help at any step. A person reads every message, and we usually reply within one business day. To help you, we may need to open your project. We do that only when you ask for help, when you report a problem, or when we need to look into a technical fault, a complaint or a breach of these terms.
3.7 Changes to the service
We improve the service over time, so styles, music, features and limits may change. If a change removes something you have already paid for, we'll offer you a fair alternative or a refund for that purchase.
4. Price, payment and taxes
4.1 Price
Creating a project and watching the preview is free. Downloading the finished video costs the price shown on the site at the time of purchase, currently $59 (US dollars), paid once. There is no subscription and nothing renews. Checkout may show the price in your local currency.
4.2 Dodo Payments is the merchant of record
Payments are handled by Dodo Payments, which acts as the merchant of record and reseller for your purchase. That means Dodo Payments processes the payment, collects and pays any sales tax or VAT, and issues your receipt or invoice. When you pay, you also agree to the terms Dodo Payments shows at checkout. The charge on your card statement may appear under Dodo Payments or InMemoryVideo.
We never see or store your full card number. Payment details are handled by Dodo Payments and its payment partners.
4.3 Taxes
Depending on where you live, sales tax, VAT or a similar tax may be added at checkout. The total you pay is shown before you confirm the payment.
4.4 Failed payments and chargebacks
If a payment fails or is reversed, we may hold the download and memorial page until it's resolved. If something went wrong with a purchase, please write to us before disputing the charge with your bank. We can usually refund you faster than a chargeback takes.
4.5 Price changes
We may change the price in the future. A change never affects a purchase you have already made.
5. What you get and how long we keep it
5.1 What you receive
Right after payment you can download the full video as an MP4 file in 1080p, without the watermark. We also email the download link to the address you gave at checkout. Your purchase includes a memorial page with the video for 12 months from the date of payment.
5.2 Please keep a copy
Download your video as soon as it's ready and keep a copy on your computer, phone or a USB stick. We work hard to keep files safe, but we can't promise they will be available forever, and after the periods in section 5.4 we delete them.
5.3 The memorial page
The memorial page is not listed publicly and is set up so that search engines don't index it. Anyone who has the link can watch the video, so share the link with the people you want to see it. You can ask us to take the page down at any time. After 12 months the page closes. If we later offer a way to keep a page longer, we'll tell you before it closes; you won't be charged without your agreement.
5.4 How long we keep projects
- Paid projects: photos, the video and the memorial page are kept for 12 months after payment, then deleted.
- Unpaid projects: deleted 90 days after the last change.
- Any project: deleted sooner if you ask us.
Deleted projects can't be restored. The MP4 file you downloaded is yours to keep.
6. Refunds
If you're not happy with your video for any reason, you can ask for a full refund within 30 days of payment. You don't have to explain why. After a refund, the download link and memorial page stop working. The details are in our Refund Policy.
7. Your photos and content
7.1 Your content stays yours
You keep every right you have in your content. We don't claim ownership of your photos, names, dates or words.
7.2 The permission you give us
To make the service work, you give us a limited, non-exclusive, worldwide, royalty-free permission to store, copy, resize, crop, analyze and combine your content with styles and music, to show it to you and the people you share links with, and to deliver it to you. We use this permission only to provide the service to you, to give you support and to keep the service safe. We don't use your content for advertising, we don't sell it, and we don't use it to train AI models. The permission ends when your project is deleted, except for copies in backups that are erased on their normal schedule and anything we must keep by law.
7.3 Your promises about your content
When you or your contributors add content, you confirm that:
- you own the photos or have permission from the person who does, for example the photographer or the family member who keeps them;
- making a memorial video with the content is appropriate, and where it matters, the closest family agrees to it;
- the content doesn't break any law and doesn't infringe anyone's copyright, privacy or other rights.
Photos taken by professional photographers or studios can be protected by copyright. Families usually have permission to use their own portraits for personal purposes, but if you're unsure, ask the photographer.
7.4 Photos of other people and of children
Memorial videos often include relatives and friends who are alive, including children. Please include people respectfully and leave out photos that someone in them would not want shown. If a person in a photo, or a parent of a child in a photo, asks us to remove it, we may remove it from the project and the memorial page.
7.5 Content that isn't allowed
Please don't upload or add anything that:
- is sexual or shows nudity, or sexualizes anyone, and never anything involving a minor in that way;
- is hateful, harassing, threatening or meant to mock or humiliate a person, living or dead;
- shows graphic violence or injury, including images of a person's body after death;
- infringes someone else's copyright, trademark, privacy or publicity rights;
- contains personal documents of others, such as ID cards, medical records or financial details;
- is used to impersonate someone, to deceive, or to make a memorial for someone who hasn't died without their consent;
- contains viruses or anything designed to harm the service or other people.
7.6 Reports and removal
We don't review projects in advance. If we receive a report, or we otherwise learn that content breaks these terms or the law, we may remove the content, disable the memorial page or close the project. Where we can, we'll tell you why and give you a chance to respond. To report content, write to support@inmemoryvideo.com with the link and the reason.
8. Music
8.1 Our music library
Music in the video comes from our library of instrumental pieces, which we license from music providers. The license belongs to us; when you buy a video, we pass on to you the right to use the music as part of that video, as described below.
8.2 What you can do
- Play the video privately, at home or in any personal setting.
- Show it at a funeral, memorial service, visitation, celebration of life or similar gathering, including in a funeral home or place of worship, and during a livestream of that gathering.
- Share it with family and friends, and on the memorial page.
8.3 What you can't do
- Extract the music from the video or use it separately.
- Sell the video or use it in advertising, monetized channels or any commercial project.
- Broadcast it on television or radio, or show it in a cinema or other paid event.
8.4 Video platforms and social networks
Platforms such as YouTube or Facebook use automated systems to match music. Even when your use is allowed, a platform may mute, block or flag a video because of the music. We don't control those systems and can't promise that a video posted there will play with sound.
8.5 If a track has to be replaced
If we lose the right to use a track, we may need to replace it on memorial pages with a similar piece. This doesn't affect a video you have already downloaded and use as described above.
9. Our service and materials
The service, its software, design, styles, templates, transitions, music library and the InMemoryVideo name and logo belong to us or to our licensors. Your video combines your content with these materials. When you pay, you may use the finished video for any personal, non-commercial purpose, within the music rules in section 8. Previews with a watermark are for viewing on the site only; please don't record or capture them to avoid paying.
If you send us ideas or suggestions, we may use them to improve the service without owing you anything. We are grateful for them.
10. Copyright complaints
We respect the rights of photographers, artists and other creators. If you believe content on the service infringes your copyright, send a notice to support@inmemoryvideo.com with the subject "Copyright notice" that includes:
- your name, address, phone number and email address;
- a description of the work you believe has been infringed;
- the link to the project or memorial page and a description of the content;
- a statement that you believe in good faith that the use isn't authorized by the owner, its agent or the law;
- a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the owner or authorized to act for the owner;
- your physical or electronic signature.
When we receive a complete notice, we'll remove or disable the content and let the person who added it know. If that person believes the removal was a mistake, they can send us a counter-notice with their contact details, a description of the content, a statement under penalty of perjury that they believe it was removed by mistake, and their consent to the jurisdiction of a court where they live. We may restore the content if the person who complained doesn't start legal action within 14 business days. We close projects of people who repeatedly infringe others' rights.
11. Rules for using the service
Please use the service only for making and sharing memorial videos as intended. You must not:
- remove or hide the watermark, or get around payment in any other way;
- copy, scrape or collect content or data from the service with bots or other automated means;
- try to access projects that aren't yours by guessing or collecting links;
- break, overload or probe the service, or interfere with its security;
- reverse engineer the software, except where the law allows it;
- resell the service or offer it to others as your own, unless we agree in writing;
- use the service in breach of any law.
12. Suspension and ending
You can stop using the service at any time and ask us to delete your project.
We may suspend or close a project, or refuse service, if you seriously or repeatedly break these terms, if we must do so by law, or if it's needed to protect other people or the service. Where we can, we'll tell you first and give you a chance to fix the problem. If we close a paid project without a good reason related to your conduct, we'll refund what you paid for it.
If we ever decide to shut down the service, we'll give you at least 30 days' notice by email so you can download your video, and we'll refund in full any purchase made in the 30 days before we announce it.
Sections that by their nature should continue, such as 7.2, 9, 13, 14, 15, 17 and 18, continue after your use of the service ends.
13. Disclaimers
We put care into the service, but software isn't perfect. Apart from the promises we make in these terms and the rights you have by law, the service is provided "as is" and "as available". We don't promise that it will always be available or free of errors, that automatic ordering, cropping or timing will be exactly right, or that the video will meet every expectation. That is why you can watch the full preview before paying and ask for a refund within 30 days.
InMemoryVideo makes videos. We don't provide funeral, burial or cremation services, and we don't give grief counseling or medical, psychological or legal advice. If you are struggling, please reach out to people close to you or to a professional.
14. Limits on our liability
To the extent the law allows:
- we aren't liable for losses that weren't reasonably foreseeable, or for indirect or consequential losses such as lost profits, lost opportunities or lost data that you could have kept by downloading your video;
- our total liability to you for all claims connected with the service is limited to the amount you paid us in the 12 months before the claim, or $100 if that is more.
We know these videos are made at a painful time and matter a great deal. Even so, to the extent the law allows, we aren't liable for emotional distress or other non-financial harm caused by delays, technical faults or the content of a video. If something goes wrong, please tell us right away so we can try to fix it, and download the finished video as soon as it's ready.
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that the law doesn't allow to be limited.
15. Your responsibility to us
If someone makes a claim against us because content you or your contributors added breaks their rights or the law, or because you broke these terms, you agree to cover our reasonable costs of dealing with the claim, to the extent the law allows. We'll tell you about the claim promptly and let you take part in how it's handled.
16. Your consumer rights
If you are a consumer, you have rights under the laws of the country or state where you live that these terms can't take away. Nothing in these terms limits those rights.
If you live in the European Union, the United Kingdom or another country with a similar rule, you may have a legal right to cancel an online purchase within 14 days. For digital content, that right ends once the download starts with your agreement. When you choose to download right after paying, you agree to this. Our 30-day refund in the Refund Policy still applies and is longer than the legal period.
17. Disputes and governing law
17.1 Talk to us first
Most problems can be solved quickly by email. If you have a complaint, please write to support@inmemoryvideo.com and give us 30 days to try to resolve it before starting any formal claim.
17.2 Governing law
These terms are governed by the laws of the Republic of Indonesia. If you are a consumer, you also keep the protection of the mandatory laws of the country or state where you live.
17.3 Where claims are heard
Any dispute that we can't resolve informally may be brought in the courts of Indonesia. If you are a consumer, you may also bring a claim in the courts of the place where you live, including a small claims court, where the law gives you that right.
18. General terms
- These terms, together with the documents listed in section 1.3, are the whole agreement between you and us about the service.
- If a court finds part of these terms invalid, the rest stays in effect.
- If we don't enforce a right straight away, we can still enforce it later.
- You can't transfer your rights under these terms to someone else without our agreement. We may transfer ours to a business that takes over the service, as long as your rights aren't reduced.
- We aren't responsible for delays or failures caused by events outside our reasonable control, such as outages at hosting or payment providers, natural disasters or government actions.
- You agree that we can send you notices about your purchase by email to the address you gave us.
- These terms are written in English. If we provide a translation, the English version applies if they differ.
19. Changes to these terms
We may update these terms as the service changes or laws change. We'll show the new date at the top, and if a change is important we'll also say so on the site. Changes don't apply to purchases you made before them. If you keep using the service after a change, the updated terms apply.
